TR CU 021/2011 “On the safety of food products”

TR CU 021/2011 was developed to protect the health and life of people, the environment, to provide consumers with reliable information about products. It establishes:

  • objects to which it applies;
  • rules enabling accurate identification of regulated objects in the process of testing or registration of certain documents;
  • forms and schemes of confirmation of conformity;

Safety standards for various types of products and food raw materials.

Products falling within the scope of TR CU 021/2011

TR CU 021/2011 applies to food products, as well as the processes of their life cycle (from production to disposal). These are products of any origin, in natural, processed and processed form, which are intended to be consumed in food, including drinking water, specialty foods, food additives, alcohol, dietary supplements, yeast and food raw materials.

Food products (and related processes) that are produced by citizens at home, in their own gardens and orchards, for personal consumption do not fall within the scope of TR CU 021/2011.

How conformity is confirmed

TR CU 021/2011 establishes three forms (methods) by which it is assessed whether products meet the established requirements:

  1. declaration (except for vinegar, unprocessed food products of animal origin and specialized products);
  2. state registration (new and specialized products must be registered; the state registration certificate is issued by Rospotrebnadzor);
  3. veterinary and sanitary expertise (it is required for unprocessed products of animal origin in accordance with Article 21 of the Law № 4979-1 of 14.05.1993).

TR CU 021/2011 is a general technical regulation that establishes requirements for all food products at once, but there are other technical regulations, with a narrow scope of application, which regulate certain types of products: meat, dairy, fish, fat and oil products, drinking water, juices, specialty foods and food additives. Accordingly, these types of products must meet the requirements of all technical regulations that apply to them.

Declaration of TR CU 021/2011

The declaration procedure under the rules established in Article 23, conducted by the applicant (declarant) itself, that is, a person in whose name the declaration is issued. This may be the manufacturer of products, its seller and the official representative of a foreign manufacturer, registered on the territory of the EEC as a legal entity or individual entrepreneur.

According to paragraph 10 of Article 23, the validity of the declaration shall be established by the applicant, unless the technical regulations on certain types of products stipulate otherwise.

The declaration must be registered in the national part of the Single Register (FGIS FSA) in the manner approved by the Government of the Russian Federation from 19.06.2021 № 936.
